Las normas finales propuestas por los peticionarios establecen un camino claro para que la OCC adopte medidas de protecci\u00f3n m\u00e1s estrictas para prevenir el abandono de pozos de petr\u00f3leo y gas.<\/p>\n<p>La modernizaci\u00f3n de los requisitos de fianzas permitir\u00eda alinear mejor las garant\u00edas financieras presentadas por las empresas petroleras y gas\u00edferas con el coste real del sellado de pozos, lo que ayudar\u00eda a proteger a las familias de Nuevo M\u00e9xico, el agua potable, la tierra y los fondos p\u00fablicos.<\/p>\n<p>Nuevo M\u00e9xico enfrenta una creciente crisis de pozos desatascados, con miles de pozos viejos en riesgo de ser abandonados sin la financiaci\u00f3n adecuada para su limpieza. Junio de 2025 <a href=\"https:\/\/www.nmlegis.gov\/Entity\/LFC\/Documents\/Program_Evaluation_Reports\/LFC%20Policy%20Spotlight%20-%20Orphaned%20Wells%20-%20Final.pdf\" target=\"_blank\" rel=\"noopener\">reporte<\/a> Seg\u00fan estimaciones del Comit\u00e9 de Finanzas Legislativas, el estado podr\u00eda tener m\u00e1s de 5000 pozos abandonados y entre 1.040 millones y 1.600 millones de d\u00f3lares en gastos de limpieza en los pr\u00f3ximos a\u00f1os. Las normas que previenen esos da\u00f1os y exigen que las empresas limpien el desastre que causaron son simplemente sentido com\u00fan y decencia com\u00fan\u201d.\u201d<\/p>\n<p>\u201cNecesitamos agencias que reciban financiaci\u00f3n para proteger a los habitantes de Nuevo M\u00e9xico que tienen m\u00e1s probabilidades de perder por pozos abandonados o potencialmente hu\u00e9rfanos\u201d, dijo.<b> Camilla Feibelman, Directora del Cap\u00edtulo de R\u00edo Grande del Sierra Club. <\/b>\u201cLas industrias que operan aqu\u00ed deben comportarse como buenos vecinos, limitar su impacto en nuestra salud, aire y agua, y proporcionar la financiaci\u00f3n necesaria para la limpieza desde el principio.\u201d<\/p>\n<p><b>Por qu\u00e9 es importante:<\/b><\/p>\n<p>Cuando los pozos no se sellan adecuadamente al final de su vida \u00fatil, pueden filtrar sustancias qu\u00edmicas t\u00f3xicas al aire y a las aguas subterr\u00e1neas, lo que supone un riesgo para la salud p\u00fablica, la agricultura, la fauna silvestre y las comunidades cercanas. Los pozos abandonados tambi\u00e9n son una importante fuente de contaminaci\u00f3n por metano, un potente gas de efecto invernadero que acelera el cambio clim\u00e1tico.<\/p>\n<p>Bajo el sistema de fianzas actual, las empresas petroleras y gas\u00edferas pueden operar cientos o incluso miles de pozos aportando solo una peque\u00f1a fracci\u00f3n del dinero necesario para sellarlos. Cuando las operadoras abandonan los pozos o se declaran en bancarrota, el costo de la limpieza recae sobre el estado.<\/p>\n<p>Las recientes medidas coercitivas del estado, incluida una <a href=\"https:\/\/sfreporter.com\/news\/new-mexico-targets-oil-companies-in-sweeping-environmental-l\/\" target=\"_blank\" rel=\"noopener\">demanda judicial<\/a> La denuncia presentada por el Fiscal General de Nuevo M\u00e9xico, en la que se alega que los operadores utilizaron empresas fantasma y la declaraci\u00f3n de bancarrota para eludir las responsabilidades de limpieza, subraya los riesgos que se producen cuando fallan las medidas de protecci\u00f3n financiera.<\/p>\n<p>La garant\u00eda funciona como un dep\u00f3sito de seguridad: las empresas petroleras y gas\u00edsticas deben reservar fondos por adelantado para garantizar que los pozos se sellen y limpien adecuadamente cuando finalice la perforaci\u00f3n.<\/p>\n<p><b>\u00bfQu\u00e9 har\u00edan las normas propuestas?<\/b><\/p>\n<p>Los cambios en las normas que se est\u00e1n considerando ser\u00edan los siguientes:<\/p>\n<ul>\n<li aria-level=\"1\">Actualizar los requisitos de fianza a $150,000 por pozo para los pozos de petr\u00f3leo y gas con mayor riesgo de abandono, incluidos los pozos de baja producci\u00f3n e inactivos, para que se ajusten mejor a los costos reales de taponamiento de la Divisi\u00f3n de Conservaci\u00f3n de Petr\u00f3leo.<\/li>\n<li aria-level=\"1\">Exigir a los operadores con carteras de alto riesgo (m\u00e1s del 20 por ciento de pozos inactivos) que depositen una fianza individual de $150,000 para todos los pozos, reduciendo as\u00ed el riesgo de que grandes carteras de pozos antiguos se queden sin fondos suficientes para su limpieza.<\/li>\n<li aria-level=\"1\">Reforzar las normas de transferencia de pozos para evitar que operadores con escasos recursos o que no cumplen con la normativa adquieran pozos antiguos, una v\u00eda com\u00fan hacia el abandono de pozos.<\/li>\n<li aria-level=\"1\">Exigir que los pozos m\u00e1s marginales (que producen menos de 90 barriles de petr\u00f3leo equivalente en 12 meses) demuestren que a\u00fan cumplen una funci\u00f3n \u00fatil o que se sellen adecuadamente.<\/li>\n<li aria-level=\"1\">Endurecer las normas para los pozos inactivos exigiendo a los operadores que demuestren que los pozos volver\u00e1n a producir en el futuro, evitando as\u00ed que los pozos improductivos permanezcan indefinidamente sin ser limpiados.<\/li>\n<\/ul>\n<p><b>Amplio apoyo p\u00fablico:<\/b><\/p>\n<p>Los habitantes de Nuevo M\u00e9xico en todo el estado han manifestado un fuerte apoyo a la modernizaci\u00f3n de las normas sobre bonos.<\/p>\n<ul>\n<li aria-level=\"1\">M\u00e1s de 900 art\u00edculos p\u00fablicos escritos <a href=\"https:\/\/www.riograndesierraclub.org\/stronger-oil-gas-cleanup-rules\/\" target=\"_blank\" rel=\"noopener\">comentarios<\/a> apoyar la reforma.<\/li>\n<li aria-level=\"1\">Veinticinco funcionarios electos de todo Nuevo M\u00e9xico firmaron <a href=\"https:\/\/www.westernleaders.org\/nm-bonding-rules-letter-11-5-25\" target=\"_blank\" rel=\"noopener\">letras<\/a> y realiz\u00f3 comentarios p\u00fablicos en apoyo de requisitos de fianza m\u00e1s estrictos.<\/li>\n<li aria-level=\"1\">En todo el estado <a href=\"https:\/\/drive.google.com\/file\/d\/11rK3FTNUTWHlrxOxDsfqitPUc7p43rSV\/view%5C\" target=\"_blank\" rel=\"noopener\">votaci\u00f3n<\/a> La encuesta muestra que el 89 por ciento de los habitantes de Nuevo M\u00e9xico apoya la obligaci\u00f3n de que las empresas petroleras y de gas paguen por la limpieza de los pozos que perforan.<\/li>\n<\/ul>\n<p><b>\u00bfQu\u00e9 sigue?<\/b><\/p>\n<p>La OCC revisar\u00e1 ahora los informes posteriores a la audiencia mientras se prepara para deliberar sobre posibles actualizaciones de las normas estatales sobre emisi\u00f3n de bonos.<\/p>\n<p>Los comisionados tienen ahora la oportunidad de adoptar medidas de protecci\u00f3n modernas que reflejen mejor los costes actuales de limpieza y garanticen que las empresas de
