La demanda alega que el DEQ se ha otorgado una discreci\u00f3n pr\u00e1cticamente ilimitada para decidir qu\u00e9 se considera \u201cimportante\u201d o \u201cmenor\u201d, sin criterios claros ni forma alguna para que el p\u00fablico pueda consultar o impugnar dicha clasificaci\u00f3n en tiempo real. En consecuencia, la agencia ha aprobado discretamente numerosas modificaciones a los permisos de minas de carb\u00f3n \u2014que afectan a los planes de protecci\u00f3n del agua, las obligaciones de recuperaci\u00f3n y otras salvaguardias fundamentales\u2014 sin publicar los documentos, recabar la opini\u00f3n p\u00fablica ni notificar a las comunidades afectadas.<\/p>\n<p dir=\"ltr\">Decenas de estas revisiones se han realizado a planes de mitigaci\u00f3n de manantiales y pozos para ganado, aprobados como parte del permiso otorgado a Signal Peak Energy para la mina Bull Mountains en el condado de Musselshell. Estos planes tienen como objetivo proteger los recursos h\u00eddricos de los que dependen los miembros de Northern Plains y BMLA. Los grupos han expresado su preocupaci\u00f3n ante el Departamento de Calidad Ambiental (DEQ) por su pr\u00e1ctica de autorizar cambios al permiso sin la participaci\u00f3n p\u00fablica y han solicitado oportunidades para participar de manera significativa. El DEQ ha ignorado estas preocupaciones.
