Seg\u00fan <a href=\"https:\/\/leg.mt.gov\/bills\/mca\/title_0020\/chapter_0040\/part_0030\/section_0150\/0020-0040-0030-0150.html\" target=\"_blank\" rel=\"noopener\">Ley del Estado<\/a>, el PSC tiene 60 d\u00edas a partir de la fecha de presentaci\u00f3n de una petici\u00f3n de reglamentaci\u00f3n para aceptar o rechazar la solicitud de comenzar la reglamentaci\u00f3n. La fecha l\u00edmite para esto era el 28 de abril. El 30 de abril, el PSC vot\u00f3 para extender el per\u00edodo de comentarios p\u00fablicos hasta el 1 de julio, afirmando estar interesado en recopilar m\u00e1s informaci\u00f3n del p\u00fablico y dejando en claro que no estaban tomando ninguna decisi\u00f3n sobre si aceptar o no. denegar la petici\u00f3n.<\/p>\n<p>El 9 de mayo, los peticionarios <a href=\"https:\/\/meic.org\/wp-content\/uploads\/2024\/05\/2024-09-05_Notice-re-extension-of-public-comment.pdf\" target=\"_blank\" rel=\"noopener\">present\u00f3 una presentaci\u00f3n<\/a> y el PSC destaca el requisito atrasado de cumplir con el plazo de 60 d\u00edas para aceptar o rechazar la petici\u00f3n de reglamentaci\u00f3n. El PSC, como la mayor\u00eda de las agencias gubernamentales del estado, tiene prohibido participar en la elaboraci\u00f3n de normas durante los tres meses previos a la sesi\u00f3n legislativa, que comienza el primer d\u00eda h\u00e1bil de 2025. La decisi\u00f3n de extender sustancialmente el per\u00edodo de comentarios p\u00fablicos podr\u00eda retrasar significativamente una decisi\u00f3n del PSC, si no impedirla por completo, infligiendo m\u00e1s da\u00f1o constitucional a los peticionarios y a todos los habitantes de Montana.<\/p>\n<p>&quot;Los habitantes de Montana necesitan que nuestros funcionarios estatales sigan las leyes que exigen respuestas oportunas a peticiones como la nuestra&quot;, dijo <b>Melissa Hornbein del Western Environmental Law Center.<\/b> \u201cEl hecho de que la Comisi\u00f3n no haya actuado sobre esta petici\u00f3n dentro del tiempo requerido arroja nuestro futuro en la incertidumbre. Por lo tanto, nos unimos a otros peticionarios para pedirle a un tribunal que refuerce su obligaci\u00f3n legal de responder\u201d.<\/p>\n<p>\u201cInstamos al PSC a cumplir con su deber constitucional y estatutario de aceptar o rechazar la petici\u00f3n de reglamentaci\u00f3n\u201d, dijo <b>Winona Rachel con Familias por un clima habitable<\/b>. \u201cLas familias de Montana cuentan con que el PSC haga su trabajo para proteger el futuro de nuestros hijos y nuestros bolsillos. El clima ya est\u00e1 afectando los medios de vida, la seguridad y la salud de los habitantes de Montana y no hay tiempo para detenerse: m\u00e1s tarde es demasiado tarde\u201d.<\/p>\n<p>El subconjunto de peticionarios que se unen a la orden judicial de acci\u00f3n mandamus son el Cap\u00edtulo de Montana de la Academia Estadounidense de Pediatr\u00eda, Bridger Bowl Ski Area, Citizens for Clean Energy, Climate Smart Missoula, Families for a Livable Climate, Gallatin Valley Sunrise, Helena Hunters y Pescadores, Centro de Informaci\u00f3n Ambiental de Montana, Consejo de Recursos de las Llanuras del Norte, Consejo Ambiental del Condado de Park y 350 Montana.<\/p>\n<p>&quot;La Comisi\u00f3n tendr\u00e1 muchas oportunidades de hacer preguntas a los peticionarios y solicitar m\u00e1s comentarios p\u00fablicos despu\u00e9s de que inicie el proceso de elaboraci\u00f3n de normas&quot;, dijo <b>Nick Fitzmaurice con el<\/b> <b>Centro de Informaci\u00f3n Ambiental de Montana<\/b>. \u201cEl momento para tal discusi\u00f3n es durante el proceso de elaboraci\u00f3n de reglas, y estaremos encantados de participar y responder preguntas en ese momento. Gallatin Valley Sunrise est\u00e1 desconcertado por este retraso, que no es m\u00e1s que una t\u00e1ctica dilatoria para proteger los intereses privados\u201d.<\/p>\n<p>Los tribunales de Montana han determinado dos veces que el estado tiene la obligaci\u00f3n de considerar el cambio clim\u00e1tico en la toma de decisiones. Con una amplia autoridad de supervisi\u00f3n sobre los servicios p\u00fablicos de Montana, el PSC tiene el papel m\u00e1s trascendental de cualquier organismo de toma de decisiones en el estado a la hora de determinar el impacto de Montana en el clima. La falta de acci\u00f3n del PSC perjudica la salud humana, causa graves da\u00f1os econ\u00f3micos a personas y empresas en todo el estado, y pone a los contribuyentes en riesgo de una escalada continua de tarifas impulsadas a\u00fan m\u00e1s por inversiones en activos de servicios p\u00fablicos que pronto quedar\u00e1n varados.<\/p>\n<p>El PSC escuch\u00f3 a m\u00e1s de 50 proponentes de la petici\u00f3n en una reuni\u00f3n p\u00fablica el 8 de abril, muchos de los cuales citaron los beneficios econ\u00f3micos de considerar el cambio clim\u00e1tico y las desventajas econ\u00f3micas de seguir ignor\u00e1ndolo. Otras comisiones de servicios p\u00fablicos en todo el pa\u00eds tienen en cuenta el cambio clim\u00e1tico en su regulaci\u00f3n de servicios p\u00fablicos porque esta pr\u00e1ctica protege a los consumidores del aumento de los costos y de las inversiones arriesgadas en recursos cuyos da\u00f1os superan sus beneficios.
