En 2022, Big Oil adquiri\u00f3 una <a href=\"https:\/\/www.reuters.com\/business\/energy\/big-oil-doubles-profits-blockbuster-2022-2023-02-08\/\" target=\"_blank\" rel=\"noopener\">r\u00e9cord de $219 mil millones en ganancias<\/a>, duplicando sus \u201cganancias\u201d respecto al a\u00f1o anterior. Estas tarifas de alquiler no cambiar\u00e1n el comportamiento de la industria, ni es probable que los aumentos en los pagos de regal\u00edas lo hagan.<\/p>\n<p>El mismo sentimiento se aplica al aumento de las tarifas de fianza de la regla propuesta. Si bien es apropiado aumentar las tasas de los bonos por encima de $10,000 establecido en 1960, las nuevas tasas propuestas siguen siendo inadecuadas. La naci\u00f3n no solo debe asegurarse de que los pozos futuros est\u00e9n tapados, tambi\u00e9n debemos tapar la capacidad estimada por la EPA <a href=\"https:\/\/www.washingtonpost.com\/climate-solutions\/2023\/04\/11\/plugging-abandoned-oil-wells\/\" target=\"_blank\" rel=\"noopener\">millones de pozos abandonados<\/a> que existen hoy. Esto ya ha empujado los gastos de la industria del petr\u00f3leo y el gas al p\u00fablico por una suma de $4.7 mil millones solo en la Ley de Infraestructura Bipartidista. El metano es un gas de efecto invernadero 86 veces m\u00e1s potente que el di\u00f3xido de carbono a corto plazo.<\/p>\n<p>Las disposiciones de la regla propuesta para proteger el h\u00e1bitat de la vida silvestre y los sitios culturales sensibles se leen como una ocurrencia tard\u00eda para ubicar nuevos permisos cerca de la infraestructura y el equipo existentes. El lenguaje de la regla propuesta deja un gran margen de maniobra para la toma de decisiones subjetivas sobre si los sitios culturales o el h\u00e1bitat de la vida silvestre se proteger\u00e1n en absoluto y, de ser as\u00ed, cu\u00e1les. Adem\u00e1s, si bien la norma propuesta reconoce la autoridad de la Oficina en virtud de la Ley Federal de Gesti\u00f3n y Pol\u00edtica de Tierras (FLPMA, por sus siglas en ingl\u00e9s) para evitar la &quot;degradaci\u00f3n innecesaria o indebida&quot;, la norma propuesta tambi\u00e9n pierde una oportunidad importante de implementar una estrategia para mitigar al menos parcialmente el clima y otros impactos del programa de arrendamiento de petr\u00f3leo y gas. La Oficina debe hacer m\u00e1s para cumplir con esta obligaci\u00f3n bajo FLPMA.<\/p>\n<p>De manera similar, si bien la Oficina reconoce correctamente el potencial de impactos desproporcionadamente altos, adversos y acumulativos del arrendamiento y la perforaci\u00f3n en las &quot;comunidades desatendidas&quot; y la justicia ambiental, y su autoridad para exigir medidas razonables para evitar, minimizar o mitigar esos impactos, la regla propuesta no <i>asegurar<\/i> tales protecciones.
