Washington Department of Ecology<\/em>, the<br \/>\nclimate change case brought by eight young citizens of Washington State. In her<br \/>\ndecision, Judge Hill ordered the Washington Department of Ecology (\u201cEcology\u201d) to<br \/>\nreconsider the petition the eight youth filed with Ecology last year asking for<br \/>\ncarbon dioxide reductions, and to report back to the court by July 8, 2015, as<br \/>\nto whether they will consider the undisputed current science necessary for<br \/>\nclimate recovery.<span style=\"color: #222222;\"> <\/span><\/span><\/p>\n<p><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-US;\">Last June, the young petitioners<br \/>\nfiled a<span style=\"color: #222222;\"> <\/span><\/span><a href=\"http:\/\/ourchildrenstrust.org\/sites\/default\/files\/Petition.Final_.6.17.14.pdf\"><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-US;\">petition<br \/>\nfor rulemaking<\/span><\/a><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: #222222; mso-fareast-language: EN-US;\"> <\/span><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-US;\">to Ecology requesting that the<br \/>\nagency<span style=\"color: #222222;\"> promulgate a rule that would limit carbon<br \/>\ndioxide emissions in Washington according to what scientists say is needed to<br \/>\nprotect our oceans and climate system. The youth also asked Ecology to inform<br \/>\nthe Legislature that existing statutory greenhouse gas reductions must be<br \/>\nrevised based on current climate science. On August 14, 2014, Ecology denied<br \/>\nthe petition without disputing the underlying scientific bases for petitioner\u2019s<br \/>\nplea. Arguing that they have a fundamental right to a healthy environment, and<br \/>\nthat they are faced with increasing harms posed by climate destabilization and<br \/>\nocean acidification, the young petitioners filed an appeal of the denial to<br \/>\nvindicate this right on behalf of themselves and future generations.<\/span><\/span><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: #222222; mso-fareast-language: EN-US;\"> <br \/><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: black; mso-themecolor: text1; background: white; mso-fareast-language: EN-US;\">\u201cThe<br \/>\neffect of this decision is that for the first time in the United States, a<br \/>\ncourt of law has ordered a state agency to consider the most current and best<br \/>\navailable climate science when deciding to regulate carbon dioxide emissions,\u201d<br \/>\nsaid Andrea Rodgers<\/span><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: black; mso-themecolor: text1; mso-fareast-language: EN-US;\"> of the Western<br \/>\nEnvironmental Law Center, attorney for the youth petitioners.<span style=\"background: white;\"> \u201cThe court directed Ecology to apply the agency\u2019s own<br \/>\nfindings that climate change presents an imminent threat to Washington and<br \/>\ndemands immediate action. The ball is now in Ecology\u2019s court to do the right<br \/>\nthing and protect our children<\/span><\/span><span style=\"color: black; mso-themecolor: text1;\"> <\/span><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: black; mso-themecolor: text1; background: white; mso-fareast-language: EN-US;\">and<br \/>\nfuture generations.\u201d<\/span><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: black; mso-themecolor: text1; mso-fareast-language: EN-US;\">&nbsp;<\/span><\/p>\n<p><span style=\"color: black; mso-themecolor: text1; mso-fareast-language: EN-US;\">In a footnote to her order,<br \/>\nJudge Hill explained her plain reasoning for rejecting Ecology\u2019s plan to delay<br \/>\naction, referencing a December 2014 report from Ecology: <br \/><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left: .5in; background: white;\"><span style=\"font-size: 9.5pt; font-family: Arial; mso-bidi-font-family: Arial; color: black; mso-themecolor: text1; mso-fareast-language: EN-US;\"><span style=\"mso-spacerun: yes;\">&nbsp;<\/span><\/span><span style=\"color: black; mso-themecolor: text1; mso-fareast-language: EN-US;\">\u201cEcology suggests no change in greenhouse gas<br \/>\nreduction standards until after an international climate conference scheduled<br \/>\nin Paris in December 2015, thus delaying action for at least a year from the<br \/>\ndate of the report or one year and five months after the report\u2019s original due<br \/>\ndate. Neither in its briefing nor in oral argument of this appeal did the<br \/>\nDepartment seek to justify this suggested delay. The report itself states that<br \/>\nafter the Paris conference Washington would be better informed how the state\u2019s limits<br \/>\nshould be adjusted.\u201d<\/span><\/p>\n<p><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: #222222; mso-fareast-language: EN-US;\">\u201cKids understand<br \/>\nthe threats climate change will have on our future,\u201d said 13-year-old<br \/>\npetitioner Zoe Foster. \u201cI\u2019m not going to sit by and watch my government do<br \/>\nnothing. We don\u2019t have time to waste. I\u2019m pushing my government to take real<br \/>\naction on climate, and I won\u2019t stop until change is made.\u201d <br \/><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background: white;\"><span style=\"mso-fareast-font-family: &quot;Times New Roman&quot;; color: black; mso-themecolor: text1; mso-fareast-language: EN-US;\">The<br \/>\ncourt\u2019s opinion acknowledges that climate change is currently happening and<br \/>\nwill have devastating impacts on the natural environment of Washington. Citing<br \/>\nEcology\u2019s December report, the court wrote:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left: .5in; background: white;\"><span style=\"color: black; mso-themecolor: text1;\">\u201cWashington State\u2019s existing statutory<br \/>\nlimits should be adjusted to better reflect the current science.
