Judge Orders Washington Environmental Agency to Consider Youth-Proposed Carbon Dioxide Reductions<\/div>\n

On Tuesday, King County Superior Court
\nJudge Hollis Hill issued a <\/span><\/span>landmark
\ndecision<\/span><\/a> <\/span>in Zoe & Stella Foster v. Washington Department of Ecology<\/em>, the
\nclimate change case brought by eight young citizens of Washington State. In her
\ndecision, Judge Hill ordered the Washington Department of Ecology (\u201cEcology\u201d) to
\nreconsider the petition the eight youth filed with Ecology last year asking for
\ncarbon dioxide reductions, and to report back to the court by July 8, 2015, as
\nto whether they will consider the undisputed current science necessary for
\nclimate recovery. <\/span><\/span><\/p>\n

Last June, the young petitioners
\nfiled a <\/span><\/span>petition
\nfor rulemaking<\/span><\/a> <\/span>to Ecology requesting that the
\nagency promulgate a rule that would limit carbon
\ndioxide emissions in Washington according to what scientists say is needed to
\nprotect our oceans and climate system. The youth also asked Ecology to inform
\nthe Legislature that existing statutory greenhouse gas reductions must be
\nrevised based on current climate science. On August 14, 2014, Ecology denied
\nthe petition without disputing the underlying scientific bases for petitioner\u2019s
\nplea. Arguing that they have a fundamental right to a healthy environment, and
\nthat they are faced with increasing harms posed by climate destabilization and
\nocean acidification, the young petitioners filed an appeal of the denial to
\nvindicate this right on behalf of themselves and future generations.<\/span><\/span>
<\/span><\/p>\n

\u201cThe
\neffect of this decision is that for the first time in the United States, a
\ncourt of law has ordered a state agency to consider the most current and best
\navailable climate science when deciding to regulate carbon dioxide emissions,\u201d
\nsaid Andrea Rodgers<\/span> of the Western
\nEnvironmental Law Center, attorney for the youth petitioners. \u201cThe court directed Ecology to apply the agency\u2019s own
\nfindings that climate change presents an imminent threat to Washington and
\ndemands immediate action. The ball is now in Ecology\u2019s court to do the right
\nthing and protect our children<\/span><\/span> <\/span>and
\nfuture generations.\u201d<\/span> <\/span><\/p>\n

In a footnote to her order,
\nJudge Hill explained her plain reasoning for rejecting Ecology\u2019s plan to delay
\naction, referencing a December 2014 report from Ecology:
<\/span><\/p>\n

 <\/span><\/span>\u201cEcology suggests no change in greenhouse gas
\nreduction standards until after an international climate conference scheduled
\nin Paris in December 2015, thus delaying action for at least a year from the
\ndate of the report or one year and five months after the report\u2019s original due
\ndate. Neither in its briefing nor in oral argument of this appeal did the
\nDepartment seek to justify this suggested delay. The report itself states that
\nafter the Paris conference Washington would be better informed how the state\u2019s limits
\nshould be adjusted.\u201d<\/span><\/p>\n

\u201cKids understand
\nthe threats climate change will have on our future,\u201d said 13-year-old
\npetitioner Zoe Foster. \u201cI\u2019m not going to sit by and watch my government do
\nnothing. We don\u2019t have time to waste. I\u2019m pushing my government to take real
\naction on climate, and I won\u2019t stop until change is made.\u201d
<\/span><\/p>\n

The
\ncourt\u2019s opinion acknowledges that climate change is currently happening and
\nwill have devastating impacts on the natural environment of Washington. Citing
\nEcology\u2019s December report, the court wrote:<\/span><\/p>\n

\u201cWashington State\u2019s existing statutory
\nlimits should be adjusted to better reflect the current science. The limits
\nneed to be more aggressive in order for Washington to do its part to address
\nclimate risks.\u201d<\/span><\/p>\n

Ecology has recognized that \u201cwe are
\nimposing risks on future generations (causing intergenerational inequities) and
\nliability for the harm that will be caused by climate change that we are unable
\nor unwilling to avoid.\u201d<\/span>
<\/span><\/p>\n

Current
\nclimate science finds that atmospheric carbon dioxide levels must be reduced
\nfrom the current global annual mean concentration of 401 parts per million,[1]<\/span><\/span><\/span><\/span><\/a>
\nto 350 ppm by 2100 in order to achieve climate stabilization and protect our
\noceans from catastrophic acidification. <\/span><\/p>\n

\u201cThis
\nencouraging court decision reminds us that there is still good basis for
\noptimism about legal strategies that aim to require governments to draft an
\naction plan consistent with a more stringent mitigation target than the ones
\nthat are commonly discussed,\u201d said the youth\u2019s expert, NASA climate scientist Dr.
\nPushker Kharecha.<\/span>[2]<\/span><\/span><\/span><\/span><\/span><\/a> \u201cI hope the Department of
\nEcology realizes that such a plan would be more achievable than they think in
\nthis case, and that they will therefore choose to amend their decision
\naccordingly.\u201d<\/span> <\/span>
<\/span><\/p>\n

\u201cThis is a
\ndecision of immense national significance,\u201d said Julia Olson, executive director
\nof Our Children\u2019s Trust, the nonprofit spearheading similar cases around the
\ncountry. \u201cJudge Hill acknowledges the urgent and dire acceleration of global
\nwarming, refuses to accept any more bureaucratic delay, and mandates that the State
\nconsider and act in just two weeks time on the youth\u2019s scientific evidence that
\natmospheric levels of carbon dioxide must be reduced to 350 ppm. This judge
\nunderstands the role of the judiciary to enforce citizen\u2019s rights to fair
\nevaluation of their grounded petitions and the critical urgency that government
\nact substantively and without delay to protect the state\u2019s resources and the
\nchildren who depend on them.\u201d<\/span><\/p>\n

\u201cThe court’s decision brings a
\nfeeling of triumph,\u201d said 14-year-old petitioner Aji Piper. \u201cBut I know there
\nis still a lot of work to be done. We may have one a battle, but we’re still
\nfighting a bigger war.\u201d<\/span> <\/span>
<\/span><\/p>\n

The youth
\npetitioners acted with the help of Our Children\u2019s Trust, an Oregon-based
\nnonprofit orchestrating a global, game-changing, youth-driven legal campaign to
\nestablish the right to a healthy atmosphere and stable climate. <\/span>The legal effort advances the
\nfundamental duty of government today: to address the climate crisis based on
\nscientific baselines and benchmarks, and to do so within timeframes determined
\nby scientific analysis.
<\/span><\/p>\n

Our Children’s Trust <\/span><\/em><\/strong>is a nonprofit
\norganization advocating for urgent emissions reductions on behalf of youth and
\nfuture generations, who have the most to lose if emissions are not reduced. OCT
\nis spearheading the international human rights and environmental TRUST Campaign
\nto compel governments to safeguard the atmosphere as a “public trust”
\nresource. We use law, film, and media to elevate their compelling voices. Our
\nultimate goal is for governments to adopt and implement enforceable
\nscience-based Climate Recovery Plans with annual emissions reductions to return
