These companies knowingly leak methane from poorly maintained equipment, deliberately vent it to the atmosphere, and burn it as a waste product from oil drilling. Since 2008, WELC has led a coalition of nearly 100 organizations working with the government to put a stop to all this waste and pollution.<\/p>\n<p>In addition to being a powerful greenhouse gas 86 times more potent than carbon dioxide, methane is bad for human health and the environment, and its waste hurts taxpayers. The methane gas wasted every year from drilling on public lands is equivalent to the climate pollution from 34 coal-fired power plants or 28 million cars. That\u2019s enough energy to power nearly 12 million homes for a full year. In addition, this lost methane means taxpayers have lost out on royalties of almost $400 million over the past decade. The Bureau of Land Management, which oversees oil and gas development on public lands, is responsible for minimizing the waste of these resources.<\/p>\n<p>The federal Government Accounting Office conservatively estimates that the U.S. Bureau of Land Management, which manages most of the oil and gas drilling on public lands, could eliminate nearly half of the methane pollution by requiring companies to implement readily-available, low-cost pollution equipment and improve maintenance practices.<\/p>\n<p>Under the Obama administration, and with input from environmentalists, fossil fuel companies, the public, and more, the EPA and BLM wrote new rules to reduce methane waste from oil and gas on public lands. Industry and some fossil fuel-heavy states challenged the rules in court, and WELC successfully intervened to defend the common-sense measures. Additionally, we helped defeat Congressional attempts to use an obscure and extreme tool called the Congressional Review Act to repeal the rule and ensure that no substantially similar citizen protection is ever enacted again. We also defeated in court a Trump administration attempt to illegally stay key portions of the BLM methane rule. We also defeated an effort by BLM to delay the rule for one year.<\/p>\n<p>More recently, BLM enacted a new rule gutting the 2016 methane waste rule. We worked for a decade to get this common-sense measure, negotiated with industry\u2019s input, across the finish line. In July 2020, we defeated the Trump administration in court resoundingly, reinstating the Obama-era methane rule. However, another case brought by oil and gas interests in the District of Wyoming went the other way, and the BLM methane waste prevention rule was invalidated. The judge in that case said BLM overstepped its limitations by considering greenhouse gas emissions limitations a benefit to &#8220;public welfare.&#8221; We&#8217;re appealing the decision to a higher court because that logic doesn&#8217;t pass muster.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=&#8221;1_3&#8243;][et_pb_text admin_label=&#8221;Staff&#8221; It is the first and only national monument specifically established to<br \/>\nprotect biological diversity. But ecologists agreed after the designation that many of the most important parts of the region were excluded from the monument&#8217;s boundaries. In 2015, 85 scientists concerned about increasing<br \/>\nthreats to the area signed a letter urging monument expansion in to better<br \/>\nprotect and connect important habitats for the monument\u2019s spectacular variety<br \/>\nof plants and animals \u201cwhose survival in the region,\u201d according the monument\u2019s<br \/>\noriginal proclamation, \u201cdepends upon its continued ecological integrity.\u201d In January 2017, President Obama expanded the monument to include these ecologically important areas.<\/span><\/p>\n<p class=\"MsoNormal\">Soon after, a timber company and the Association of O&amp;C Counties, keen on logging, filed separate lawsuits suggesting an obscure law requires the area be logged and supersedes the Antiquities Act, used to designate and expand the monument. Each train is composed of 120 cars or more, which adds up to 30 tons of lost coal per train. Investigations undertaken by our clients have turned up coal chunks and particles from rail cars in Washington\u2019s waters.<\/p>\n<p>Approximately 90% of BNSF&#8217;s annual coal shipments are from coal mines in the Powder River Basin (PRB) located in Wyoming and Montana. PRB coal breaks apart easily and contains mercury, arsenic, uranium, and hundreds of other toxins harmful to fish and human health. Additionally, PRB coal dust falls onto train tracks, contributing to track destabilization and dangerous train derailments.<\/p>\n<p>On June 5, 2013,\u00a0WELC attorney Andrea Rodgers and partners filed the suit in U.S. District Court for the Western District of Washington in Seattle, where coal dust has been identified in and along multiple waterways including the Pugent Sound. On July 24, 2013, we filed another lawsuit in\u00a0U.S. District Court for the Eastern District of Washington in Spokane, where coal dust has been identified in and along multiple waterways including the Spokane and Columbia Rivers.<\/p>\n<p>Under the Clean Water Act, anyone discharging pollutants into U.S. waters must first obtain what is known as a National Pollutant Discharge Elimination System (NPDES) permit. BNSF does not have such a permit.<\/p>\n<p>Our partners in these lawsuits are the Sierra Club, Puget Soundkeeper, Columbia Riverkeeper, RE Sources for Sustainable Communities, and Friends of the Columbia Gorge. NRDC and Spokane Riverkeeper joined the lawsuit filed in Eastern Washington.<\/p>\n<p>In addition to WELC, the plaintiffs are represented by the Law Offices of Charles M. Methane is a powerful greenhouse gas, more than 86 times as potent as carbon dioxide in causing climate change. Oil and gas companies knowingly leak methane from poorly maintained equipment, deliberately vent it to the atmosphere, and burn it as a waste product from oil drilling.<\/p>\n<p>We believe that companies drilling for oil and gas on public lands<br \/>\nshould be required to use readily available pollution controls to cut<br \/>\nthese harmful methane emissions and reduce the waste of our nation&#8217;s<br \/>\nnatural resources.<\/p>\n<p>This is no minor issue\u2014the methane gas wasted every year from drilling on public lands is equivalent to the climate pollution from 34 coal-fired power plants or 28 million cars. Conserved for use by homes, schools, and businesses, that\u2019s enough energy for nearly 12 million homes.<\/p>\n<p>The upshot of careless industry practices has been more methane in the atmosphere and less in the pipeline for consumers, reduced Federal royalties of almost $400 million over the past decade, and more wells, pipelines, and related equipment sprawling across public lands throughout the West.<\/p>\n<p>The federal Government Accounting Office conservatively estimates that the U.S. Bureau of Land Management, which manages most of the oil and gas drilling on public lands, could eliminate nearly half of the methane pollution by requiring<br \/>\ncompanies to implement readily-available, low-cost pollution equipment<br \/>\nand improve maintenance practices.<\/p>\n<p>BLM acknowledges that \u201creducing methane emissions is a powerful way to take action on climate change.\u201d Accordingly, President Obama made new methane waste rules a priority under his Climate Action Plan announced in March 2014. These new rules, updating the current rules written in 1980, will apply to all oil and gas development on federal public lands.<\/p>\n<p>Since 2008, WELC has been leading a nearly 100-member coalition of local, regional, and national groups working hard to make sure that the BLM develops the strongest possible rules to reduce the oil and gas industry&#8217;s wasteful and damaging practices. Once adopted, we will stick around to ensure that the rules are strictly enforced.<\/p>\n<p>Updates:<\/p>\n<p>3\/28\/14: The White House released the Climate Action Plan \u2013 Strategy to<br \/>\nCut Methane Emissions. Read the WH strategy in the Related Document<br \/>\nsection below.<\/p>\n<p>1\/14\/15: GOOD NEWS! The White House announced its plan to reduce harmful methane emissions from new AND existing oil and gas operations on public lands managed by BLM. The President has a goal to reduce methane emissions by 45 percent over the next decade. The Environmental Protection Agency will issue the proposed regulations in summer 2015, with final adoption set for 2016.<\/p>\n<p>8\/18\/15: EPA released its <a href=\"http:\/\/www.epa.gov\/airquality\/oilandgas\/actions.html\">proposed methane emissions rule<\/a>. Read our statement <a href=\"https:\/\/westernlaw.org\/?p=1372\">here<\/a>.<\/p>\n<p>10\/14\/15: WELC sued BLM for documents pursuant to a Freedom of Information Act request made over one year ago. WELC requested information about applications and approvals to vent or flare under BLM\u2019s current methane waste direction, called NTL-4a. Especially important to our methane waste rule advocacy are the memoranda of understanding between states and BLM addressing regulation of venting\/flaring of gas from federal leases. BLM is required to respond to such requests in 20 days or less, but has not released any documents.<\/p>\n<p>1\/22\/16: BLM released its <a href=\"http:\/\/www.blm.gov\/style\/medialib\/blm\/wo\/Communications_Directorate\/public_affairs\/news_release_attachments.Par.15043.File.dat\/VF%20Proposed%20Rule%20Waste%20Prevention.pdf\">proposed methane waste rule<\/a>. Read our statement <a href=\"https:\/\/westernlaw.org\/?p=1423\">here<\/a>.<\/p>\n<p class=\"p1\">4\/22\/16: We submitted to BLM detailed legal and technical recommendations, co-authored by the Western Organization of Resource Councils and co-signed by a diverse group of 35 partners from across the West (<a href=\"https:\/\/westernlaw.org\/sites\/default\/files\/2016.04.22-WELCetal_BLM\"><span class=\"s1\">here<\/span><\/a>).<\/p>\n<p class=\"p2\">5\/12\/16: The Obama administration finalized its EPA rule, strengthening it by increasing the frequency of required leak surveys for some sources, eliminating exemptions for marginal wells, and eliminating a &#8220;step-back&#8221; provision loophole that would have resulted in less frequent inspections for some sources. That day, two oil and gas indstry organizations, along with the states of Wyoming, North Dakota, and Montana sued the federal government over the rules. Methane is a powerful greenhouse gas, more than 86 times as potent as carbon dioxide in causing climate change. Oil and gas companies knowingly leak methane from poorly maintained equipment, deliberately vent it to the atmosphere, and burn it as a waste product from oil drilling.<\/p><p>We believe that companies drilling for oil and gas on public lands<br \/> should be required to use readily available pollution controls to cut<br \/> these harmful methane emissions and reduce the waste of our nation's<br \/> natural resources.<\/p><p>This is no minor issue\u2014the methane gas wasted every year from drilling on public lands is equivalent to the climate pollution from 34 coal-fired power plants or 28 million cars. Conserved for use by homes, schools, and businesses, that\u2019s enough energy for nearly 12 million homes.<\/p><p>The upshot of careless industry practices has been more methane in the atmosphere and less in the pipeline for consumers, reduced Federal royalties of almost $400 million over the past decade, and more wells, pipelines, and related equipment sprawling across public lands throughout the West.<\/p><p>The federal Government Accounting Office conservatively estimates that the U.S. Bureau of Land Management, which manages most of the oil and gas drilling on public lands, could eliminate nearly half of the methane pollution by requiring<br \/> companies to implement readily-available, low-cost pollution equipment<br \/> and improve maintenance practices.<\/p><p>BLM acknowledges that \u201creducing methane emissions is a powerful way to take action on climate change.\u201d Accordingly, President Obama made new methane waste rules a priority under his Climate Action Plan announced in March 2014. These new rules, updating the current rules written in 1980, will apply to all oil and gas development on federal public lands.<\/p><p>Since 2008, WELC has been leading a nearly 100-member coalition of local, regional, and national groups working hard to make sure that the BLM develops the strongest possible rules to reduce the oil and gas industry's wasteful and damaging practices. Once adopted, we will stick around to ensure that the rules are strictly enforced.<\/p><p>Updates:<\/p><p>3\/28\/14: The White House released the Climate Action Plan \u2013 Strategy to<br \/> Cut Methane Emissions. Read the WH strategy in the Related Document<br \/> section below.<\/p><p>1\/14\/15: GOOD NEWS! The White House announced its plan to reduce harmful methane emissions from new AND existing oil and gas operations on public lands managed by BLM. The President has a goal to reduce methane emissions by 45 percent over the next decade. The Environmental Protection Agency will issue the proposed regulations in summer 2015, with final adoption set for 2016.<\/p><p>8\/18\/15: EPA released its <a href=\"http:\/\/www.epa.gov\/airquality\/oilandgas\/actions.html\">proposed methane emissions rule<\/a>. Read our statement <a href=\"https:\/\/westernlaw.org\/?p=1372\">here<\/a>.<\/p><p>10\/14\/15: WELC sued BLM for documents pursuant to a Freedom of Information Act request made over one year ago. WELC requested information about applications and approvals to vent or flare under BLM\u2019s current methane waste direction, called NTL-4a. Especially important to our methane waste rule advocacy are the memoranda of understanding between states and BLM addressing regulation of venting\/flaring of gas from federal leases. BLM is required to respond to such requests in 20 days or less, but has not released any documents.<\/p><p>1\/22\/16: BLM released its <a href=\"http:\/\/www.blm.gov\/style\/medialib\/blm\/wo\/Communications_Directorate\/public_affairs\/news_release_attachments.Par.15043.File.dat\/VF%20Proposed%20Rule%20Waste%20Prevention.pdf\">proposed methane waste rule<\/a>.
