Stopping the Bull Mountain Mine Expansion<\/h1>\n<p>In the foothills of central Montana near Roundup, we kept 170 million tons of coal in the ground in 2017 and defended that victory in 2022. We defeated the Bull Mountain\/Signal Peak Mine expansion, arguing that the agency\u2019s analysis of impacts to water employed an erroneous standard and of the five springs undermined in the Bull Mountains, four have shown diminished water levels and two of the four have gone fully dry. That water is needed by nearby ranching operations for livestock, and combustion of coal from the Bull Mountain Mine will cause continued contamination of the air and water, and will exacerbate the crisis of climate change.<\/p>\n<p>However, the new environmental assessment doubled down on the original errors that led to our court victory so we sued to stop the expansion again and won in 2020.<\/p>\n<p>We won our case before the Ninth Circuit, and the District Court vacated the mine plan. We have another case before a state appeals board, challenging permitting decisions by OSM and state regulators. We are hoping that the next decision will be five-strikes-you&#8217;re-out for this destructive mining operation.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; It is the first and only national monument specifically established to<br \/>\nprotect biological diversity. But ecologists agreed after the designation that many of the most important parts of the region were excluded from the monument&#8217;s boundaries. In 2015, 85 scientists concerned about increasing<br \/>\nthreats to the area signed a letter urging monument expansion in to better<br \/>\nprotect and connect important habitats for the monument\u2019s spectacular variety<br \/>\nof plants and animals \u201cwhose survival in the region,\u201d according the monument\u2019s<br \/>\noriginal proclamation, \u201cdepends upon its continued ecological integrity.\u201d In January 2017, President Obama expanded the monument to include these ecologically important areas.<\/span><\/p>\n<p class=\"MsoNormal\">Soon after, a timber company and the Association of O&amp;C Counties, keen on logging, filed separate lawsuits suggesting an obscure law requires the area be logged and supersedes the Antiquities Act, used to designate and expand the monument. This underground coal mine consists of 7,000 permitted acres in the heart of Montana\u2019s Bull Mountains. The mine produces approximately 6 million tons of coal annually. Coal from the Bull Mountain Mine is shipped via rail to domestic power plants and abroad to Asia via existing coal export terminals in Canada.<\/p><p>Currently, the strip mine operator, Signal Peak Energy, is seeking approval to double the size of the mine by adding another 7,000 acres to access 176 million tons of coal, allowing the mine to operate until 2025. The mine uses long-wall mining, which causes the Bull Mountains to cave in and pollute the groundwater, which, in turn, harms nearby ranching operations that depend on the water for their livestock. Further, combustion of coal from the Bull Mountain Mine will cause continued contamination of the air and water, will exacerbate the crisis of climate change, and will threaten the livelihoods of ranchers in the Roundup area.<\/p><p>Under Montana law, mining cannot be permitted if it will cause violations of ground or surface water quality standards. In this case, the Montana Department of Environmental Quality seems to have gone out of its way to avoid looking at evidence that continued mining will lead to violations of groundwater quality standards.<\/p><p>In November 2013, we filed an administrative appeal on behalf of the Montana Environmental Information Center. In August 2015, we filed suit.<\/p><p class=\"p1\"><span class=\"s1\">Update 10\/16\/15:\u00a0<\/span>Victory! In the foothills of central Montana, we just kept 170 million tons of coal, underlying 7,000 acres, in the ground. We challenged the Bull Mountains\/Signal Peak Mine expansion, arguing that the agency\u2019s analysis of impacts to water employed an erroneous standard and that the evidence presented did not show that the mine wouldn\u2019t harm\u00a0groundwater.
