We were crushed when the U.S. Supreme Court gutted the Clean Water Act, removing protections for up to 95% of New Mexico\u2019s waters with the stroke of a pen. But the power of the law\u2014state law\u2014is strong.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">We took action, and with a coalition of partners and legislative champions, we worked around the clock to pass a law that restored the Clean Water Act protections slashed in the misguided Supreme Court decision. New Mexico\u2019s restored water protections will be immune from federal attacks, and we\u2019re working with the state to create the strongest program possible.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In the meantime, we participated in a state rulemaking to ban the discharge of treated fracking waste\u2014greenwashed as \u201cproduced water\u201d\u2014to New Mexico\u2019s rivers, streams, groundwater, and land. In 2021, Big Oil created 60 billion gallons of this toxic waste, containing radium, benzene, PFAS, mercury, and unknown toxic fracking chemicals.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Over the 18-month rulemaking, we presented thousands of pages of scientific evidence and expert testimony proving that the technology to treat this fracking waste to safe levels and at scale does not exist. Even an industry witness agreed that the technology \u201cisn\u2019t there yet,\u201d and the Water Quality Control Commission voted unanimously to ban the discharge of treated fracking waste in New Mexico.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Before the ink was dry on the rule, Big Oil came back to the commission with an extremely permissive, industry-written proposal to reverse the discharge ban. Alarmingly, Gov. Michelle Lujan Grisham and Environment Department Sec. James Kenney pulled strings to rig the commission\u2019s vote in favor of the industry\u2019s proposal.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In another unprecedented capitulation to Big Oil, Sec. Kenney forbade his Environment Department\u2014which proposed and argued persuasively in favor of the discharge ban\u2014from participating in Big Oil\u2019s rulemaking. This has never occurred in the 58-year history of the commission for a rule the Environment Department would administer.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">We filed a motion to disqualify the commissioners the governor directed to vote yes on Big Oil\u2019s treated fracking waste discharge proposal as well as their votes to advance this disastrous rule. The commission <a href=\"https:\/\/westernlaw.org\/new-mexico-water-commission-vacates-tainted-decision-to-hear-oil-and-gas-fracking-waste-discharge-rulemaking\/\" target=\"_blank\" rel=\"noopener\">voted to nullify its vote<\/a> to consider the industry-written oil and gas wastewater discharge rule. The application for this pipeline was denied! It was determined that the drawbacks of the pipeline outweigh its public benefits. This proposed pipeline would've brought fracked gas from the intermountain West to the Oregon coast where it would be processed and sent via ships to Asia. The 200+ mile pipeline would've clear cut a corridor at least 50-feet wide across rivers and national forests. If built, this would be the largest greenhouse gas emitting facility in Oregon. This is a victory to celebrate!<\/div><p>In December 2011, the Federal Energy Regulatory Commission (FERC) approved a proposal for construction of a liquefied natural gas (LNG) terminal, known as the Jordan Cove project, near Coos Bay Oregon, and a natural gas pipeline, known as the Pacific Connector pipeline.<\/p><p>The pipeline would be more than 200 miles long, running from\u00a0the LNG terminal across privately and publicly owned lands in southern Oregon, and then\u00a0connect to existing lines that run north-south from British Columbia to California. Initially, the project was planned to allow for natural gas to be imported at the Jordan Cove terminal then piped to California and Nevada markets. But the project changed in September 2011 to export LNG from Canada and the US Rocky Mountain region to markets in Asia.<\/p><p>In this case, we represent a group of private landowners who own property within the pipeline right-of-way, and <a href=\"http:\/\/www.oregonlive.com\/business\/index.ssf\/2014\/08\/landowners_tell_proposed_lng_e.html#incart_more_business\" target=\"_blank\">who have refused to give their permission to Pacific Connector<\/a> to destroy sensitive aquatic features on their properties. Our clients include farmers, timberland owners, ranchers, and homesteaders who have courageously stood up for their rights by fighting Pacific Connector\u2019s attempts to circumvent an important state law that protects the private property rights of all Oregonians. (<a href=\"http:\/\/video-embed.oregonlive.com\/services\/player\/bcpid1949055967001?bctid=3742325839001&bckey=AQ~~,AAAAPLpuSqE~,a1DdoZJH5WQo4iWaJj1w_CktvJfhQVVG\" target=\"_blank\">Watch an interview<\/a> of rancher Bill Gow.)<\/p><p>In April 2012, FERC withdrew the approval due the fact that the project application was for an import facility though the project is now planned to export LNG. This was a victory, however, the fight is far from over as the developers have already restarted the application process.<\/p><p>We are focusing our efforts on stopping the pipeline, which would clear cut a straight corridor at least 50 feet wide across rivers and through <strong>national forests, impacting riparian reserves, old growth groves, and recreational trails<\/strong> (including a crossing of the Pacific Crest Trail). Endangered and threatened fish species such as <strong>Chinook salmon, coho salmon, chum salmon, steelhead, coastal cutthroat trout, pacific lamprey, river lamprey, and green sturgeon<\/strong> would all be impacted.\u2028 The ecological impacts have led the U.S. Fish and Wildlife Service, National Marine Fisheries Service, and Environmental Protection Agency to raise serious concerns over the projects.<\/p><p><object data=\"http:\/\/www.youtube.com\/v\/x8CQ9Qrei3c\" type=\"application\/x-shockwave-flash\" width=\"425\" height=\"350\"><param name=\"data\" value=\"http:\/\/www.youtube.com\/v\/x8CQ9Qrei3c\" \/><param name=\"src\" value=\"http:\/\/www.youtube.com\/v\/x8CQ9Qrei3c\" \/><\/object><\/p><p><object data=\"http:\/\/www.youtube.com\/v\/saTxMqjJD9k\" type=\"application\/x-shockwave-flash\" width=\"425\" height=\"350\"><param name=\"data\" value=\"http:\/\/www.youtube.com\/v\/saTxMqjJD9k\" \/><param name=\"src\" value=\"http:\/\/www.youtube.com\/v\/saTxMqjJD9k\" \/><\/object><\/p><p>\u00a0<\/p><p><object data=\"http:\/\/www.youtube.com\/v\/ZlK7985fKeg\" type=\"application\/x-shockwave-flash\" width=\"425\" height=\"350\"><param name=\"data\" value=\"http:\/\/www.youtube.com\/v\/ZlK7985fKeg\" \/><param name=\"src\" value=\"http:\/\/www.youtube.com\/v\/ZlK7985fKeg\" \/><\/object><\/p><p>\u00a0<\/p><p><strong>Updates: <\/strong><\/p><p>In May 2013, Jordan Cove Energy Project filed a new, formal application with federal regulators to build a liquefied natural gas export facility on the north spit of Coos Bay. As Robyn Janssen with Rogue Riverkeeper, a WELC partner in our work against this ill-conceived project notes, \u201cwe plan on being fully engaged.\u201d<\/p><p>In November 2013, we submitted a Freedom of Information Act (FOIA) request to the Federal Energy Regulatory Commission (FERC) seeking disclosure of a list of interested and affected stakeholders interested in the Jordan Cove\/Pacific Connector LNG project.\u00a0Our clients, concerned by past and present shenanigans by the proponents of the Jordan Cove\/Pacific Connector project, are interested in the stakeholder list because they want to ensure that these stakeholders are adequately and correctly informed of their rights, including the right to refuse access to their private property within the right-of-way of the pipeline. In December, FERC sent Williams Pacific Connector a letter asking the company to provide comments on our FOIA request. (While asking the project proponent for feedback on a FOIA request is not unheard of, it is somewhat unusual.)\u00a0Once Williams responds to FERC, or fails to do so, FERC will make a final decision regarding our information request. Given that there is clear legal precedent requiring disclosure of this information, we are confident that we will ultimately obtain the stakeholder list, which will allow us and our clients to ensure public disclosure of this important information.<\/p><p>In March 2014, the Department of Energy granted a conditional export license to the ill-conceived Jordan Cove LNG project at Coos Bay, Oregon. But, the project is by no means a done deal.<\/p><p>In August 2014, representing a broad coalition of private property owners, business owners, and conservationists, WELC attorney Susan Jane Brown coordinating a meeting with Oregon Gov. John Kitzhaber\u2019s office to discuss the Jordan Cove-Pacific Connector liquefied natural gas (LNG) project. Following the meeting, at the request of the governor, Brown presented his staff with a scientific report detailing the dangerous impacts on climate change that the proposed project presents. (Report can be found below in the Related Documents section.)<\/p><p>In November 2014, amidst stiff controversy, the Federal Energy Regulatory Commission released a <a href=\"http:\/\/elibrary.ferc.gov\/idmws\/file_list.asp?accession_num=20141105-4006\" target=\"_blank\">Draft Environmental Impact Statement<\/a> for the proposed Jordan Cove\/Pacific Connector Liquefied Natural Gas (LNG) export project in southwest Oregon. The public was given 90 days to comment on this massive and precedent-setting proposal.<\/p><p>In February 2015, on behalf of a diverse national coalition, including conservation, commercial fishing and private property owners, the Western Environmental Law Center and Sierra Club submitted <a href=\"https:\/\/westernlaw.org\/sites\/default\/files\/JCPC DEIS Comments - FINAL.pdf\" target=\"_blank\">comments<\/a> to the Federal Energy Regulatory Commission (FERC) opposing what would become the first gas export terminal on the West Coast. In addition, more than 25,000 citizens, including businesses, ranchers, youth, climate activists, property rights advocates, anglers, and a Native American tribe sent comments critical of FERC\u2019s analysis of the project.<\/p><p>In September 2015, the Federal Energy Regulatory Commission released its Final Environmental Impact Statement for the Jordan Cove Liquefied Natural Gas terminal and Pacific Connector pipeline. Despite clear adverse impacts to forests, streams, and wildlife that would be harmed by the proposed terminal and pipeline, FERC staff recommended approval to the commission. The FEIS follows a decade-long pattern of FERC approving LNG terminals throughout the United States over the objections of local residents, scientists, U.S. businesses, private landowners, and state agencies.<\/p><p>You can count on WELC to bring the full weight of our expertise and<br \/> experience to bear in defeating \u2013 once and for all \u2013 the Jordan<br \/> Cove\/Pacific Connector LNG project.<\/p><p>VICTORY!!!!
