There, law enforcement agencies used excessive force, unlawfully spied on protestors, and used intimidation and military tactics \u2013 including tear gas, rubber bullets, concussion grenades, and water cannons \u2013 against people exercising their First Amendment right to protest.<\/p>\n<p>Our case outlines how Montana Disaster and Emergency Services and the Montana Division of Criminal Investigation violated Montanans&#8217; Constitutional right to know by failing to release documents to the ACLU of Montana following a <a href=\"https:\/\/www.aclumontana.org\/en\/press-releases\/aclu-montana-demands-information-government-surveillance-pipeline-protesters-concerns\">request in February 2018<\/a>. The agencies have provided some documents, but they were so heavily redacted they were unintelligible. Furthermore, the agencies unlawfully imposed \u201cgag orders\u201d on the documents they did provide, which prohibits the ACLU of Montana from sharing any of the information in those documents with the public. Federal documents obtained by the ACLU show that federal, state, local, and private companies have already discussed ways to quash protest activities concerning Keystone XL.<\/p>\n<p>We&#8217;re asking the Montana agencies to immediately release the requested records and lift the gag order so the documents can be made public, as they should have been from the beginning. President Trump approved construction of the KXL Pipeline as one of his first acts in office in March 2017. The Arizona District Court in Phoenix has ordered the Bureau of Land Management to re-examine its decision to allow target shooting throughout Sonoran Desert National Monument. The court found that the BLM arbitrarily ignored its own study showing that target shooting could not be safely and appropriately conducted in the monument, given the patterns and volume of visitors to the monument and number and variety of historic and natural objects found across this biologically and archaeologically dynamic landscape.<\/div><p>On January 17, 2001, President Clinton created the Sonoran Desert National Monument in southwest Arizona to protect the one of the most biologically diverse areas of the North American Desert. The area is home to large saguaro cactus forest communities and three distinct mountain ranges (all three of which are designated wilderness areas) that provide excellent habitat for a wide range of wildlife species including big horn sheep, Sonoran pronghorn (endangered species) and desert tortoise (candidate species). The Monument also contains significant archeological and historic sites.<\/p><p>As per the President\u2019s direction in the Proclamation to prepare a management plan for the Monument \u201cnecessary to protect the objects\u201d therein, BLM prepared a draft plan and environmental impact statement (EIS)\u00a0that analyzed whether and where to authorize various activities in the Monument. As part of that process, BLM evaluated whether or not to authorize recreational target shooting in the Monument and, if so, which sites would be suitable.<\/p><p>BLM\u2019s thorough analysis in the EIS identified two small areas within the Monument that may be suitable for recreational target shooting (a place called Gap Tank and Hidden Valley). Based on the analysis, however, BLM recommended closing these two areas due to safety and accessibility concerns and a finding that allocating lands for target shooting in the Monument would not be compliant with the Proclamation.<\/p><p>All other land in the Monument \u2013 including the three designated wilderness areas and large areas of lands with wilderness characteristic\u00a0\u2013\u00a0was found to be unsuitable for recreational target shooting because of potential impacts to Monument objects (including cultural properties and the area\u2019s large saguaro cactus communities and native wildlife - sonoran pronghorn and desert tortoise), visitor safety, accessibility, and physical suitability of the terrain. In the end, BLM determined that 100% of the Monument was <em>unsuitable for recreational target shooting<\/em>.<\/p><p>For yet to be fully understood reasons (the decision was made in September 2012 during the election and intense pressure from NRA), when issuing the new management plan for the Monument, BLM went counter to its recommendations and opened the whole Monument to recreational target shooting. Now, people can drive and\/or hike and target shoot wherever they would like in the Monument, even near popular hiking trails and within the three designated wilderness areas. \u00a0<\/p><p>We filed suit challenging BLM\u2019s decision to authorize recreational target shooting throughout the entire Sonoran Desert National Monument.
