Keeping 48 Billion Tons of Powder River Basin Coal in the Ground<\/h1>\n<p class=\"p1\">WELC is working with our partners toward the goal of keeping Powder River Basin coal in the ground. As we hurdle toward the point of no return on climate, the federal Bureau of Land Management attempted to make available billions of tons of fossil fuels on our public lands. The BLM\u2019s 2015 resource management plans and environmental impact statements in Wyoming and Montana exemplified this disconnect to the extreme.<\/p>\n<p class=\"p1\">The BLM\u2019s Miles City (Montana) and Buffalo (Wyoming) RMPs kept open more than 2 million acres for coal leasing, on which the agency projected about 6 billion tons of coal would be developed in the next 20 years. The plans also authorized millions of acres for oil and gas leasing, with BLM projecting that 18,000 wells will be drilled over the 20-year planning horizons.<\/p>\n<p class=\"p1\">We asked BLM to consider the indirect impacts of combustion emissions from both coal and oil and gas in the Buffalo and Miles City RMPs. In both RMPs, BLM acknowledged that fossil fuels would be combusted, but failed to address the impacts to air and water from this combustion.<\/p>\n<p class=\"p1\"><strong>We successfully argued in court for a more detailed analysis of alternatives to this billion-ton coal portfolio and a deeper study of the environmental impact the projects would have on the Powder River Basin and the climate, keeping that coal in the ground for now. As a result of our action, the BLM deferred its planned summer oil and gas lease sale representing 100,000 acres of public land and mineral rights.\u00a0<\/strong><\/p>\n<p class=\"p1\">After our court victory, BLM put forth a revised plan that is out of line with the court order in our 2018 victory. We again defeated the agency in 2022. requiring BLM to redo its plan again, this time with a no-leasing alternative by court order. In this plan, the high extraction alternative would see 48 billion tons of coal mined in the Powder River Basin.<\/p>\n<p>In a forward-thinking move and a huge victory for our advocacy and the climate, the Biden administration in 2024 selected the plan&#8217;s no-leasing alternative, keeping more than 100 billion tons of carbon dioxide and chemicals emitted in the process of coal combustion out of the atmosphere.<\/p>\n<p>This case, while monumentally positive for the climate, highlights how slow change comes to agencies. The science now shows not only that coal mining in the Powder River Basin is extremely destructive to the environment, climate, and human health, but also that it causes much more economic harm than good.<\/p>\n<p>&nbsp;<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; It is the first and only national monument specifically established to<br \/>\nprotect biological diversity. But ecologists agreed after the designation that many of the most important parts of the region were excluded from the monument&#8217;s boundaries. In 2015, 85 scientists concerned about increasing<br \/>\nthreats to the area signed a letter urging monument expansion in to better<br \/>\nprotect and connect important habitats for the monument\u2019s spectacular variety<br \/>\nof plants and animals \u201cwhose survival in the region,\u201d according the monument\u2019s<br \/>\noriginal proclamation, \u201cdepends upon its continued ecological integrity.\u201d In January 2017, President Obama expanded the monument to include these ecologically important areas.<\/span><\/p>\n<p class=\"MsoNormal\">Soon after, a timber company and the Association of O&amp;C Counties, keen on logging, filed separate lawsuits suggesting an obscure law requires the area be logged and supersedes the Antiquities Act, used to designate and expand the monument. Each train is composed of 120 cars or more, which adds up to 30 tons of lost coal per train. Investigations undertaken by our clients have turned up coal chunks and particles from rail cars in Washington\u2019s waters.<\/p>\n<p>Approximately 90% of BNSF&#8217;s annual coal shipments are from coal mines in the Powder River Basin (PRB) located in Wyoming and Montana. PRB coal breaks apart easily and contains mercury, arsenic, uranium, and hundreds of other toxins harmful to fish and human health. Additionally, PRB coal dust falls onto train tracks, contributing to track destabilization and dangerous train derailments.<\/p>\n<p>On June 5, 2013,\u00a0WELC attorney Andrea Rodgers and partners filed the suit in U.S. District Court for the Western District of Washington in Seattle, where coal dust has been identified in and along multiple waterways including the Pugent Sound. On July 24, 2013, we filed another lawsuit in\u00a0U.S. District Court for the Eastern District of Washington in Spokane, where coal dust has been identified in and along multiple waterways including the Spokane and Columbia Rivers.<\/p>\n<p>Under the Clean Water Act, anyone discharging pollutants into U.S. waters must first obtain what is known as a National Pollutant Discharge Elimination System (NPDES) permit. BNSF does not have such a permit.<\/p>\n<p>Our partners in these lawsuits are the Sierra Club, Puget Soundkeeper, Columbia Riverkeeper, RE Sources for Sustainable Communities, and Friends of the Columbia Gorge. NRDC and Spokane Riverkeeper joined the lawsuit filed in Eastern Washington.<\/p>\n<p>In addition to WELC, the plaintiffs are represented by the Law Offices of Charles M. A second federal judge &#8211; this one in Seattle, Washington &#8211; denied BNSF&#8217;s motion to dismiss our lawsuit aimed at holding them accountable for toxic coal dust that is released from uncovered coal cars polluting Washington&#8217;s waterways in violation of the Clean Water Act. The BLM\u2019s recently approved resource management plans and environmental impact statements in Wyoming and Montana exemplify this disconnect to the extreme.<\/p>\n<p class=\"p1\">The BLM\u2019s Miles City (Montana) and Buffalo (Wyoming) RMPs keep open more than 10 million acres for coal leasing, on which the agency projects about 11 billion tons of coal would be developed. The plan also authorizes millions of acres for oil and gas leasing, with BLM projecting that 18,000 wells will be drilled.<\/p>\n<p class=\"p1\">While BLM is required to offer alternatives to this coal development, the Miles City RMP\u2019s five options are all identical with respect to coal and the Buffalo RMP involves only cosmetic differences with respect to coal.<\/p>\n<p class=\"p1\">We asked BLM to consider the indirect impacts of combustion emissions from both coal and oil and gas in the Buffalo and Miles City RMPs.
