In March 2012, we won our challenge. The appellate court\u2019s decision, the first to addresses the substance of WOPR, invalidated the management plan on the grounds that \u2013 as lawyers for the federal government admitted \u2013 it illegally ignored requirements designed to protect endangered species and their forest habitat.<\/p>\n<p>In August of 2016, BLM finalized a new\u00a0plan, collectively known as the <a href=\"http:\/\/www.blm.gov\/or\/plans\/rmpswesternoregon\/\">Resource Management Plans for Western Oregon<\/a>, which eliminates protections for streamside forests, increases clearcutting, and effectively removes 2.6 million acres of federally managed public forests from the requirements of the Northwest Forest Plan.<\/p>\n<p>We aim to prove\u00a0that BLM&#8217;s new resource management plans\u00a0violate the Oregon and California Lands Act, National Environmental Policy Act, and Administrative Procedure Act, and therefore fail to support multiple uses of Oregon forests managed by the BLM.<\/p>\n<p>The BLM plan cuts corners scientifically and legally, and comes with a laundry list of negative environmental effects, including:<\/p>\n<ul class=\"ul1\">\n<li class=\"li8\">Eliminating the strong water quality and habitat provisions of the Northwest Forest Plan, reducing streamside no-logging buffers by half or more (a loss of 300,000 acres of streamside reserves). These reductions threaten wild native fish, water quality, terrestrial wildlife, and aquatic recreational opportunities.<\/li>\n<li class=\"li8\">Introducing loopholes that would increase logging in older forest, termed late-successional reserves, and eliminate survey requirements for sensitive wildlife that depend on old forest habitat to thrive. In addition, the aforementioned 300,000 acres of riparian reserves, which had been intended to grow into old forest and bolster habitat for old forest species, is now fair game for logging.<\/li>\n<li class=\"li8\">Disempowering public input and involvement by removing BLM and the plan from collaborative Adaptive Management Area efforts.<\/li>\n<li class=\"li8\">Enacting the least ambitious carbon sequestration alternative analyzed. Over the next century, the status quo would sequester twice as much carbon.<\/li>\n<li class=\"li8\">Focusing on more intensive, clearcut-style logging on nearly half a million acres of forests, abandoning the direction towards restoration of forests and watersheds under the Northwest Forest Plan.<\/li>\n<li class=\"li8\">Designating additional recreation areas, in many of which logging and off-road motorized use take precedence and could diminish\u00a0<a href=\"http:\/\/www.pewtrusts.org\/~\/media\/assets\/2016\/03\/quiet_recreation_on_blm_managed_lands_economic_contribution_2014.pdf?la=en\">the types of quiet recreation<\/a>\u00a0the vast majority of Oregonians enjoy.<\/li>\n<\/ul>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section bb_built=&#8221;1&#8243; It is the first and only national monument specifically established to<br \/>\nprotect biological diversity. But ecologists agreed after the designation that many of the most important parts of the region were excluded from the monument&#8217;s boundaries. In 2015, 85 scientists concerned about increasing<br \/>\nthreats to the area signed a letter urging monument expansion in to better<br \/>\nprotect and connect important habitats for the monument\u2019s spectacular variety<br \/>\nof plants and animals \u201cwhose survival in the region,\u201d according the monument\u2019s<br \/>\noriginal proclamation, \u201cdepends upon its continued ecological integrity.\u201d In January 2017, President Obama expanded the monument to include these ecologically important areas.<\/span><\/p>\n<p class=\"MsoNormal\">Soon after, a timber company and the Association of O&amp;C Counties, keen on logging, filed separate lawsuits suggesting an obscure law requires the area be logged and supersedes the Antiquities Act, used to designate and expand the monument.
