This decision also excluded important lynx habitat in parts of Washington, Oregon, Idaho, Montana, and other states in the species\u2019 historic, current, and available range.<\/p>\n<p>First listed as a threatened species under the Endangered Species Act in 2000, lynx are afforded protections from harm, and so is its officially designated critical habitat.\u00a0In the case of lynx, however, USFWS didn&#8217;t designate any critical habitat until 2006. That designation was inadequate, and after two successful lawsuits brought by conservationists in 2008 and 2010, a district court in Montana left USFWS&#8217;s meager lynx habitat protection in place, but remanded it to the agency for improvement. This resulted in little improvement and inadequate habitat for the lynx to have a fair shot at recovery.<\/p>\n<p>We took USFWS to court and won. The U.S. District Court for the District of Montana ordered the USFWS to reconsider its decision to exclude the Canada lynx\u2019s entire southern Rocky Mountain range from critical habitat designation. Our victory places this essential lynx habitat back on the table for protection. However, four years after our victory, the USFWS did not lift a finger to comply with the court&#8217;s order to reexamine critical habitat designations. In July 2020, we sued the USFWS again over this dereliction of duty. We also won this case, securing hard, legally binding deadlines for USFWS to publish a lynx critical habitat rule, along with frequent progress reports, also legally binding, due to the agency\u2019s long record of negligence and delay on the subject of Canada lynx recovery actions.<\/p>\n<p>In late 2024, USFWS finalized its Canada lynx recovery plan and proposed designating critical habitat for the species in the southern Rockies for the first time ever. This represents a victory for a lynx population established via reintroduction around the turn of the century. We will continue to work to help this population of Canada lynx and others in the West thrive.<\/p>\n<p>&nbsp;<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; It is the first and only national monument specifically established to<br \/>\nprotect biological diversity. But ecologists agreed after the designation that many of the most important parts of the region were excluded from the monument&#8217;s boundaries. In 2015, 85 scientists concerned about increasing<br \/>\nthreats to the area signed a letter urging monument expansion in to better<br \/>\nprotect and connect important habitats for the monument\u2019s spectacular variety<br \/>\nof plants and animals \u201cwhose survival in the region,\u201d according the monument\u2019s<br \/>\noriginal proclamation, \u201cdepends upon its continued ecological integrity.\u201d In January 2017, President Obama expanded the monument to include these ecologically important areas.<\/span><\/p>\n<p class=\"MsoNormal\">Soon after, a timber company and the Association of O&amp;C Counties, keen on logging, filed separate lawsuits suggesting an obscure law requires the area be logged and supersedes the Antiquities Act, used to designate and expand the monument. Each train is composed of 120 cars or more, which adds up to 30 tons of lost coal per train. Investigations undertaken by our clients have turned up coal chunks and particles from rail cars in Washington\u2019s waters.<\/p>\n<p>Approximately 90% of BNSF&#8217;s annual coal shipments are from coal mines in the Powder River Basin (PRB) located in Wyoming and Montana. PRB coal breaks apart easily and contains mercury, arsenic, uranium, and hundreds of other toxins harmful to fish and human health. Additionally, PRB coal dust falls onto train tracks, contributing to track destabilization and dangerous train derailments.<\/p>\n<p>On June 5, 2013,\u00a0WELC attorney Andrea Rodgers and partners filed the suit in U.S. District Court for the Western District of Washington in Seattle, where coal dust has been identified in and along multiple waterways including the Pugent Sound. On July 24, 2013, we filed another lawsuit in\u00a0U.S. District Court for the Eastern District of Washington in Spokane, where coal dust has been identified in and along multiple waterways including the Spokane and Columbia Rivers.<\/p>\n<p>Under the Clean Water Act, anyone discharging pollutants into U.S. waters must first obtain what is known as a National Pollutant Discharge Elimination System (NPDES) permit. BNSF does not have such a permit.<\/p>\n<p>Our partners in these lawsuits are the Sierra Club, Puget Soundkeeper, Columbia Riverkeeper, RE Sources for Sustainable Communities, and Friends of the Columbia Gorge. NRDC and Spokane Riverkeeper joined the lawsuit filed in Eastern Washington.<\/p>\n<p>In addition to WELC, the plaintiffs are represented by the Law Offices of Charles M. This decision also excludes important lynx habitat in<br \/>\nparts of Washington, Oregon, Idaho, Montana, and other states in the<br \/>\nspecies\u2019 historic, current, and available range.<\/p>\n<p>FWS first listed lynx as a threatened species under the Endangered<br \/>\nSpecies Act in 2000. The listing protects individual lynx from harm.<br \/>\nUnder the ESA, the agency is also required to designate critical<br \/>\nhabitat to ensure the long-term survival and recovery of the species.<br \/>\nHowever, it failed to designate any critical habitat for the<br \/>\nspecies until 2006.<\/p>\n<p>That designation was inadequate, and after<br \/>\ntwo successful lawsuits brought by conservationists in 2008 and 2010, a<br \/>\ndistrict court in Montana left FWS&#8217;s meager lynx habitat<br \/>\nprotection in place, but remanded it to the agency for improvement. This<br \/>\nresulted in today\u2019s still inadequate habitat designation.<\/p>\n<p>The day after FWS announced the new habitat protections, we notified that agency that we intend to sue to ensure the Canda lynx has the habitat it needs to avoid extinction and recover.<\/p>\n<p>Update 9\/7\/16: Victory! T<span style=\"color: #030303; font-family: Arial, Helvetica, sans-serif; font-size: 13px;\">he U.S. District Court for the District of Montana ordered the U.S Fish and Wildlife Service to reconsider its decision to exclude the Canada lynx\u2019s entire southern Rocky Mountain range.
