Saying their way of life is threatened by poorly planned expansion of a nearby coal mine, Montana ranchers, sportsmen and conservationists are seeking legal action to enforce laws aimed at preventing mining damage to streams.

Two local conservation groups, Friends of the Wild Swan and Swan View Coalition, represented by the Western Environmental Law Center, late yesterday filed a second lawsuit against the U.S. Forest Service in order to protect the pristine South Fork of the Flathead River watershed from yet another proposal to aggressively log the area.

UPDATE: In October 2011, the U.S. 9th Circuit Court of Appeals overturned a district court decision on the Lewis Clark and Clark National Forest travel plan in favor of the U S. Forest Service and Montana Wilderness Association.

Little Belt travel plan restricting vehicles ruling upheld

The 9th Circuit U.S. Court of Appeals has reversed a lower court and upheld a 2007 travel plan that restricts motorized vehicles in certain areas in three mountain ranges in Lewis and Clark National Forest, including a wilderness study area.

Court reinstates limitations on motorized travel to benefit wildlife habitat

Today, the U.S. 9th Circuit Court of Appeals overturned a district court decision on the Lewis and Clark National Forest travel plan in favor of the U S. Forest Service and Montana Wilderness Association (‘MWA’). As a result of the decision, the Lewis and Clark National Forest will restore the original 2007 travel management plan for the Little Belts Mountains.

Conservation groups are asking a higher court to evaluate their lawsuit that challenges the federal Bureau of Land Management's plan for the Upper Missouri River Breaks National Monument in central Montana ...

"We believe the BLM's plan as written turns the monument into a motorized playground," said Matthew Bishop of the Western Environmental Law Center in Helena. "It allows motorized use through air, land and water throughout the entire monument." ...
